Getting Still maintains this website, any courses offered and other linked and related sites (the “Site”) for the use of its customers, vendors, students, and other Site users (“Users”) upon agreement to the following terms. Please read the terms carefully before using the Site. Use of this website indicates acceptance of these “Terms of Use” and forms a binding agreement between you and Getting Still. If you do not agree to these terms, do not use this Site.

1. Use of Site

Getting Still provides various materials, information, quizzes, tests, questions, articles, news and other information on this and related sites and in courses offered through this site (the “Materials”). Getting Still authorizes each User to view and download one copy of the Materials. Materials may be downloaded and a maximum of one copy of the Materials may be printed provided that Users make no modifications to the Materials and you retain all copyright and other proprietary notices contained in the original Materials on any copies of the Materials. Users may not modify the Materials at this Site in any way or reproduce, share or distribute them. Users will keep all Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Materials or their contents, to any other person or entity. Any breach of these Terms of Use automatically terminates your authorized use of the Site.

2. Trademark and Copyright

The Materials on this Site are copyrighted, and any unauthorized use of any Materials on this Site may violate copyright, trademark, and other laws. As a student of Getting Still trainings, I understand:                                   

The Content is licensed, not sold to student, and shall only be used by student in accordance with this Agreement. Title to and full ownership of any trade secrets, copyrights, trademarks and other intellectual property rights related to the Content will remain with Getting Still (Company) and/or its suppliers, licensors or Content providers. I acknowledge that the Content is Company’s proprietary property, and student shall respect Company's proprietary rights therein.                                    

Getting Still grants to student a personal, non-exclusive, non-transferable limited license to access the Site and Content for use solely for training, educational and personal purposes. Student may not use the Content for any commercial purpose. No other rights to the Website or to the Content are granted.                            

Use of The Content student shall not:

5.1 modify the Content in any way;

5.2 sublicense, commercialize, resell or use the Content otherwise than as expressly authorized in this Agreement;

5.3 incorporate the Content in any product or service that I make available to a third party whether on a commercial basis or not;

5.4 remove or alter any proprietary notices or legends on the Content; and develop or produce adaptations, enhancements, modifications, derivative works or improvements of the Content.

Links to external websites are provided solely as a convenience to you. Getting Still has not reviewed all of these external websites, does not control and is not responsible for any of these sites or their content. If you decide to access any of the external websites linked to this Site, you do so entirely at your own risk.

4. No Warranty

The Materials provided at this site are provided “as is” without any warranties of any kind including warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. Getting Still further does not warrant the accuracy and completeness of the Materials at this Site. Getting Still may make changes to the Materials at this Site, or to the services and prices described in them, at any time without notice. The Materials at this Site may be out of date, and Getting Still makes no commitment to update the Materials at this Site.

5. Course cancellation, refund & transfer policy

We at Getting Still (Company) want you to be satisfied with your purchase. Please read our clear and explicit Refund Policy carefully before purchasing. 

Self-study courses (pre-recorded, on-demand training only) 

Because of the “on-demand” nature of self-study training courses, we cannot issue any refund for materials that have already been viewed, received, or used, this applies to any and all Courses, Training, and Modules available through Getting Still.

Hybrid-study courses & training (pre-recorded, on-demand + LIVE training)

We at Getting Still (Company) want you to be satisfied with your purchase, but we also want you to give your best effort to apply yourself in the course. For this reason, Getting Still provides a 7-day money-back guarantee for our Hybrid-study training courses (Program). That money-back guarantee is governed by the following terms.

In order to qualify for a refund you must submit proof that you did the work in the course and tell us why it did not work for you. In the event that you decide your purchase was not the right decision, contact our support team at [email protected] and let us know you’d like a refund within 7 days after the date the first module is released, by 3:59pm EST (“Refund Period”). You must include your coursework with your request for a refund, as outlined below. If you request a refund and do not include your coursework by the end of the Refund Period, you will not be granted a refund.

You must submit ALL of the following items with your request for a refund:

• Requirement 1: Complete all lectures, practices, and quizzes in the first Module.
• Requirement 2: Answer all “questions for digging deeper” in our private community group.
• Requirement 3: Attach at least five sentences telling us why this course was not a good fit for you. What did you expect that you did not get once inside the program?

We will NOT provide refunds for any request that comes more than 7 days after the date of Module 1 release. After the Refund Period, all payments are non-refundable and you are responsible for full payment of the fees for the program regardless of whether you complete the program.

Please note: If you opted for a payment plan and you do not request a refund within the Refund Period, with the required coursework at the time of your refund request, you are required by law to complete the remaining payments of your payment plan.

Upon determining that you are entitled to a refund pursuant to this policy, the Company will promptly issue an instruction to its payment processor to issue the refund. The Company does not control its payment processor and will not be able to expedite any refunds.

If you receive a refund of any purchase through this money-back guarantee, that shall immediately terminate any and all licenses granted you to use the material provided to you under this Agreement and the Company’s Terms of Use. You shall immediately cease using the material and shall destroy all copies of the information provided to you, including without limitation: video recordings, audio recordings, forms, template documents, slide shows, membership areas, social media groups limited to paying members, and other resources.

All refunds are discretionary as determined by Getting Still, LLC.  To further clarify, we will not provide refunds for requests made after the Refund Period and all payments must be made on a timely basis. If payments are not made on time, you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.

In all other cases, because of the extensive time, effort, preparation and care that goes into creating and providing the Program, the Company has a no refund policy. Unless otherwise provided by law, you acknowledge that we do not offer refunds for any portion of your payment for any of our Program and no refunds will be provided to you. By using and/or purchasing our Program, you understand and agree that, except for the limited refund policy described above, all sales are final and no refunds will be provided.

Since we have a clear and explicit Refund Policy in these terms that you have agreed to prior to completing the purchase of the Program, we do not tolerate or accept any type of chargeback threat or actual chargeback from your credit card company or payment processor. If a chargeback is placed on a purchase or we receive a chargeback threat during or after your purchase, we reserve the right to report the incident to all three credit reporting agencies or to any other entity for inclusion in any chargeback database or for listing as a delinquent account, which could have a negative impact on your credit report score. The information reported will include your name, email address, order date, order amount, and billing address. Chargeback abusers wishing to be removed from the database shall make the payment for the amount of the chargeback.

Other Terms and Conditions:

♣    Online training courses may NOT be transferred to another student.

♣    Orders placed with a “Yoga School” or “Discount Code” are NOT eligible for refund, cancellation or transfer. NO EXCEPTIONS.

Course Access Policy:

♣    Expired courses, students who have left their yoga school or students who do not complete online training course requirements are NOT eligible for credit or refund of any kind, regardless of time spent in the course or time remaining.

5. Limitation of Liability

In no event will Getting Still, its suppliers, or other third parties mentioned at this Site be liable for any damages whatsoever arising out of the use, inability to use, or the results of the use of this Site, any websites liked to this Site, or the Materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. If your use of the Materials or information from this Site results in the need for servicing, repair or correction of equipment or data, you assume all costs thereof.

6. Applicable Law

The Terms of Use are governed by the laws of North Carolina, US. Failure to enforce strict performance of the Terms of Use of Use shall not be construed as a waiver of any provision or right. The Sanctuary at Getting Still may assign its rights and duties under the Terms of Use without notice to any party at any time.

7. Effective Date and Updates

The Terms are effective as of November 11th, 2020 and are subject to change without notice by Getting Still at any time. Please check for changes regularly. Your use of this Site after such changes constitutes your agreement to such changes.
